TERMS AND CONDITIONS FOR GIFT CARDS – BUSINESS

1. THE SELLER

The seller of gift cards is:

2. THE BUYER

These terms apply when a company or other legal entity purchases gift cards from Pincho Nation AB. The buyer must be an authorised representative of the company. By placing an order, the buyer confirms that they have the authority to enter into binding agreements on behalf of the company.

3. GIFT CARDS AND DELIVERY TERMS

The gift card is valid for one (1) year from the date of purchase. After the expiry date, the gift card can no longer be used. The gift card cannot be redeemed for cash, and any unused balance will not be refunded.

Gift cards are valid at all restaurants operating under the name PINCHOS/PINCHO NATION that accept gift cards and in the currency in which the card was issued.

Delivery is made by physical gift cards sent by post to the address provided by the company at the time of ordering. Delivery takes place once payment has been received in accordance with section 6 below. Pincho Nation AB is not responsible for incorrectly provided delivery details.

Delivery times vary depending on the destination and cannot be guaranteed. For deliveries within Sweden, the estimated delivery time is normally 2–5 business days, while deliveries to countries outside Sweden may take 5–14 business days or longer. Pincho Nation AB accepts no liability for delays caused by the postal operator or other circumstances beyond our control.

For administrative reasons, Pincho Nation AB does not accept orders for fewer than five (5) gift cards or with a value below SEK 200 per card.


4. BONUS POINTS

No bonus points are awarded to the buyer when purchasing gift cards through a business account. The recipient of the gift card does, however, earn bonus points upon redemption, in accordance with the terms applicable to the Pinchos bonus programme.


5. ENTERING INTO THE AGREEMENT

An agreement between Pincho Nation AB and the company is deemed to have been entered into when Pincho Nation AB has received the order and confirmed it by email. Pincho Nation AB reserves the right to decline an order, including in cases of suspected improper use, insufficient creditworthiness, or incorrect information.

6. PRICE AND PAYMENT

All prices are stated in the local currency of the country in which the gift card is intended to be redeemed, and are exclusive of VAT, as gift cards are not subject to VAT.

A handling fee of 100 kronor / EUR 10 per invoice will be added to each order.

Upon receipt of an order, a proforma invoice will be sent to the company. The invoice must be paid in full before delivery takes place. Pincho Nation AB reserves the right to carry out a credit check on the company prior to invoicing.

Delivery of gift cards takes place only once payment has been registered. The invoice is binding; unpaid orders are automatically cancelled after the stated payment deadline.


7. ORDER CONFIRMATION

Once the order has been received, an order confirmation will be sent to the email address provided by the company. The confirmation serves as proof that the order has been registered.


8. RIGHT OF WITHDRAWAL

Business purchases are not subject to consumer law rights of withdrawal. No right to cancellation, buyback, or refund applies once an order has been confirmed and an invoice has been issued.

9. COMPLAINTS REGARDING ERRORS OR DELAYS

If delivery is delayed or if the gift card is damaged or otherwise defective, the buyer must contact Pincho Nation AB as soon as possible, and no later than within a reasonable time after the defect was discovered, at presentkort@pinchos.se. The message must include the company's name, registration number, contact person, and order number.

Pincho Nation AB is liable only for direct damages caused by negligence, and never for indirect damages or losses such as loss of production or loss of profit.


10. GOVERNING LAW AND DISPUTES

These terms and conditions are governed by Swedish law. Disputes arising in connection with these terms shall in the first instance be resolved through negotiation between the parties. If a dispute cannot be resolved through negotiation, it shall be finally settled by arbitration in accordance with the Rules for Expedited Arbitration of the Arbitration Institute of the Stockholm Chamber of Commerce (SCC). The seat of arbitration shall be Gothenburg and the language shall be Swedish.

11. PROCESSING OF PERSONAL DATA

Personal data provided in connection with an order is processed by Pincho Nation AB in accordance with the company's privacy policy, available at www.pinchonation.com. Personal data refers to information relating to both the buyer's (the company's contact person) and the recipient's details and is used solely for the purpose of administering the order and the delivery of the gift cards.
